1. Acceptance of Terms
By accessing and using Shard Cloud services, you agree to comply with and be bound by the following terms and conditions of use. If you do not agree to any part of these terms, please do not use our services.
2. Description of Services
Shard Cloud provides cloud hosting services for applications, bots, databases, VPS, and websites. Our services include scalable infrastructure, technical support, and development tools.
3. User Responsibilities
You are responsible for: (a) maintaining the confidentiality of your access credentials; (b) all content that you upload or host on our services; (c) complying with all applicable laws when using our services; (d) not using our services for illegal or malicious activities.
4. Payment Terms
Payments are processed according to your chosen plan. All prices are subject to change with prior notice. Non-payment may result in suspension or cancellation of services.
5. Refund Policy
1. Refunds are applicable only for payments made directly through Shard Cloud's official channels and linked to the provided plans. Shard Cloud is not responsible for charges, services, or transactions intermediated by third parties without prior authorization from the company.
2. Opening disputes with payment processors will result in immediate cancellation of your account and active plan, as well as loss of refund rights. The same applies to disputes opened through extraordinary means, such as MED (Extraordinary Refund Measures from the Central Bank) or other regulatory mechanisms, which should not be used in cases of commercial disagreement.
3. You may request cancellation of your plan at any time, without additional costs. Cancellation must be requested through the platform's official support channels. After cancellation, access to resources will be terminated and there will be no refund of amounts already paid. After 7 (seven) calendar days from the date of the first payment, the plan cannot be cancelled or refunded.
4. Refund requests must be made exclusively through Shard Cloud's Discord support channel. The request must contain: full name, registration email, account ID, invoice reference, and purchase date. Any inconsistency in the information provided or suspicion of fraud will result in denial of the request.
In case of violation of the Terms of Use, internal policies, or involvement in illegal activities, refunds will not be granted under any circumstances.
6. Data Policy
We respect your privacy and protect your data according to our Privacy Policy. You retain ownership of your data, and we are committed to protecting it with appropriate security measures.
7. Termination
Either party may terminate this agreement at any time. In case of termination, you will have limited access to your data for a period of 30 days for recovery purposes.
8. Limitation of Liability
Shard Cloud shall not be liable for indirect, incidental, special, or consequential damages resulting from the use or inability to use our services.
9. Changes to Terms
We reserve the right to modify these terms at any time. Changes will take effect immediately upon posting. It is your responsibility to review these terms periodically.
